Rules and Regulations
• Trip balance is to be paid in full at the time service is rendered. Furocious, LLC d/b/a The Fur Bus (hereinafter “TFB”) accepts personal checks, Visa, MasterCard, Discover and American Express.
• Passenger is liable for any damages to the interior or exterior of TFB vehicle (“the vehicle”). Damages include, but are not limited to, broken or defaced windows, broken televisions, VCR’s, lighting and handrails, broken or stained upholstery and any broken, defaced and/or stained property belonging to TFB. If damages occur, a minimum of $300.00 for repair and/or cleaning of the vehicle will be charged to the credit card used to make the trip reservation.
• The following are prohibited on all Fur Bus vehicles: food, smoking, illegal drugs/controlled substances, weapons, and sexual activity.
• The consumption of alcoholic beverages or tobacco products by a minor is unlawful. No one under the age of 21 is allowed to consume or transport alcoholic beverages on a Fur Bus vehicle. TFB does not provide alcoholic beverages.
• TFB, its employees, agents and assigns have the right to refuse service to anyone at their discretion. Rentals can be cancelled if the driver feels that he/she or the passengers are unsafe. If any passenger is behaving in a disorderly, unsafe or illegal manner, the driver of the vehicle can return the group to the first point of pick up or discharge the passengers at the point where the offensive behavior occurs. In the event that TFB is forced to cancel the rental because of behavior of passenger(s), TFB’s obligations under the charter contract will immediately become null and void, the trip deposit will be forfeited, and the entire trip balance will be charged to the credit card used to make the trip reservation. No refund will be available. TFB, its employees, agents or assigns shall be the sole judge of the passengers’ safety and condition and the appropriate measures to be taken. TFB, its employees, agents or assigns making such determination shall not be liable for any mistake in judgment exercised in good faith.
• Passenger, by signing the trip sheet, (1) waives, releases and discharges TFB, its employees, agents and assigns from any and all claims relating to passenger’s transportation via a TFB vehicle except for claims due to TFB’s gross negligence or intentional acts; (2) assumes any and all risks of personal injury or property damage and releases and holds harmless TFB from any and all liability for personal injury or damage to personal property except that caused by TFB’s gross negligence or intentional acts; and (3) indemnifies and holds TFB harmless from any loss, liability, damage, cost or expense, including litigation, which may occur as a result of any personal injury or property damage except that caused by TFB’s gross negligence or intentional acts. Passenger is aware that by signing the trip sheet, passenger is releasingTFB from the above detailed liability as well as creating a contract between passenger and TFB. TFB is not responsible for any damage, loss, injury or death suffered by passenger in cases where (1) passenger’s own fault or omission is involved; (2) unforeseeable or unavoidable fault of a third party unconnected with the provision of any services by TFB is involved; and (3) unusual and unforeseeable circumstances beyond the control of TFB occur.
• Passenger shall be liable to and indemnify TFB for any fines or penalties imposed on TFB by any authorities for passenger’s failure to observe or comply with any local and/or federal laws or regulations. This indemnification shall include all costs and attorney’s fees incurred by TFB in connection with such actions.
• Passenger agrees that if TFB uses legal counsel, a collection agent or other person to enforce payment of the trip balance or damages, passenger will pay the collection costs, attorney’s fees, court costs and other expenses incurred by TFB in obtaining payment of amounts due and interest at the highest rate allowed by law on any unpaid amounts due.
• Neither TFB nor the passenger will incur any liability to the other if either’s performance is prevented or delayed by causes beyond its control and without the fault or negligence of either party. Causes beyond TFB and the passenger’s control include, but are not limited to, acts of God or war, changes in controlling law, regulations, orders or the requirements of any governmental entity, severe weather, civil disorders, technical problems with transport, natural disasters, fire, epidemics and quarantines.
• All terms, provisions, rates, conditions and other restrictions herein contained are subject to change at any time with or without notice.
